Terms of Use
Effective date: 9 October 2026
Last updated: 12 October 2026
These Terms of Use ("Terms") are a legal agreement between you and Dynomite ("we", "us", "our"). They cover the Terry: Llama Pet Step Counter app ("Terry", "the app"), Terry+, the invite page at walkwithterry.web.app and everything else we provide with them (together, the "Service"). These Terms are the end user licence agreement for the app. They are also called our Terms of Service.
Please read them carefully. They limit our liability and set where disputes are decided.
By tapping to agree during setup, or by downloading, installing or using Terry, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Terry.

1. Who can use Terry
- You must be at least 13 years old, or at least 16 in the European Economic Area and the United Kingdom.
- If you are under the age of adulthood where you live, a parent or guardian must agree to these Terms for you.
- You may not use Terry if the law forbids it, or if we have suspended or removed your account before.
2. Your account
- Give accurate information and keep it up to date.
- Keep your device and password safe. You are responsible for everything done with your account.
- Your account is for you alone. Do not sell, share or transfer it.
- Tell us right away at dynomite.app@gmail.com if you think someone else is using your account.
3. Not medical advice
Terry is a fun walking companion. It is not a medical device and it does not give medical advice.
- Nothing in Terry diagnoses, treats, cures or prevents any disease or condition.
- Terry's shapes (Very round, Round, Balanced, Active, Fit) are playful illustrations of your recent step counts. They are not an assessment of your body, weight or health.
- Step goals and suggestions are general. They are not tailored medical or fitness advice.
- Step counts, distance and exercise minutes come from Apple Health and your device sensors. They may be incomplete, delayed or wrong.
- Talk to a doctor before you start or change an exercise routine, especially if you have a health condition, are pregnant or have not exercised in a while.
- Do not rely on Terry in an emergency. Call your local emergency number.
4. Walk safely
Walking and exercise carry a risk of injury. You choose to take part voluntarily, you accept all of those risks, and you walk and exercise at your own risk.
- Stay aware of your surroundings, traffic and weather.
- Do not look at your phone while crossing roads, driving or doing anything that needs your attention.
- Stop if you feel pain, dizziness or shortness of breath.
- Follow local laws and respect private property.
To the maximum extent permitted by applicable law, we are not responsible for any injury, illness, loss or damage that happens while you walk, exercise or use Terry.
5. Your licence to use Terry
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Terry for your own non-commercial use, on Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts linked to the purchaser through Family Sharing or volume purchasing may also use it where Apple allows.
You may not:
- copy, modify, translate or make derivative works of Terry
- reverse engineer, decompile or try to get Terry's source code, except where the law allows it despite this restriction
- rent, lease, lend, sell, sublicense or redistribute Terry
- remove or change any copyright, trademark or other notice
- get around any security, access control, purchase or usage limit
- use bots, scrapers or automated means to access the Service
- use Terry to build a competing product
Terry, the Terry character, its name, artwork, animations, logos and all related rights belong to Dynomite or our licensors. We keep all rights we do not expressly give you.
6. Terry+
Terry+ is our paid upgrade. Plans may include:
- Terry+ Monthly: an auto-renewing subscription, renewed every month.
- Terry+ Yearly: an auto-renewing subscription, renewed every year. It may include a free trial or an introductory price for new subscribers.
- Terry+ Lifetime: a one-time purchase. It does not renew.
The current plans, prices, trial lengths and what each plan includes are shown in the app before you buy. Prices can vary by country and may include tax.
How subscriptions work:
- Payment is charged to your Apple ID account when you confirm the purchase.
- Your subscription renews automatically at the end of each period, at the price shown in the app, unless you cancel at least 24 hours before the current period ends.
- Your Apple ID account is charged for the renewal within the 24 hours before the current period ends.
- If you start a free trial, you are charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends when you buy a subscription.
- An introductory price applies only for the period shown. After that, the regular price applies.
- Manage or cancel your subscription in iPhone Settings > [your name] > Subscriptions, or in the App Store. Deleting the app or your Terry account does not cancel your subscription.
- If you cancel, renewal stops and you keep Terry+ until the end of the period you already paid for. Cancelling does not refund the current period unless Apple grants a refund or the law requires one.
- If a price changes, Apple tells you beforehand and asks for your consent where required.
Lifetime is a one-time, non-renewing purchase tied to your Apple ID. It gives you access to Terry+ for as long as we offer Terry and Terry+, not for your lifetime or ours. You can restore it on your devices signed in with the same Apple ID in Settings > Restore purchases.
Payments and refunds: Apple processes all payments. We cannot see your payment details and cannot issue refunds ourselves. To ask for a refund, go to reportaproblem.apple.com. Refunds are at Apple's discretion and follow Apple's policies.
We may change, add or remove Terry+ features, plans and prices for future periods. A price change never applies to a period you have already paid for, and Apple tells you before a renewal at a new price.
7. Friends and your content
Your content means anything you add to Terry: your nickname, display name and username, notes, photos, cheers and messages, reports and feedback.
- You own your content.
- You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, change the format of and show your content, only as needed to run and secure the Service and to show it to the people you choose (for example, your name and Terry's shape to your friends). This licence ends when you delete the content or your account, except for copies we keep as described in the Privacy Policy.
- You promise you have the rights to the content you add, and that it follows these Terms and the law.
- Your notes and photos are private to you. You decide who you add as a friend and what you share with them.
- We may, but do not have to, check, filter, review or remove any content. Names, usernames and cheer messages are checked against a list of blocked words. We are not responsible for content we did not create.
- We are not responsible for what other users do, say or share, inside or outside Terry. Only add people you trust.
- If you share your invite link publicly, anyone with it can see your username.
Feedback: if you send us ideas or suggestions, we may use them freely, without paying you or owing you anything.
8. Acceptable use
We have zero tolerance for objectionable content and abusive users. You must not:
- harass, bully, threaten, stalk or intimidate anyone
- post or send anything hateful, discriminatory, sexual, violent, obscene, defamatory or otherwise offensive
- pick a name or username that is offensive, misleading or impersonates someone else
- send spam, or use cheers and nudges to pester people
- share other people's personal information without their permission
- break the law or encourage others to break it
- interfere with the Service, overload it, probe it for weaknesses or get around its limits
- create accounts to get around a block, suspension or ban
You can block and report your friends and anyone who sends you a friend request, from their profile or from the request, or report anyone by emailing dynomite.app@gmail.com. Reporting someone in the app also blocks them. We review reports within 24 hours. When content or a user breaks these Terms, we remove the content and suspend or remove the account responsible. We decide in our sole discretion whether content or behaviour breaks these Terms.
9. Suspension and termination
- We may suspend, limit or end your access to all or part of the Service at any time, with or without notice, if you break these Terms, if we must by law, to protect users or the Service, or if we stop offering the Service.
- You can stop using Terry at any time and delete your account in Settings > My Account > Delete account.
- If your account ends, your licence ends and your data is handled as described in the Privacy Policy. Paid subscriptions are not refunded by us; see section 6.
- To the maximum extent permitted by applicable law, we are not liable to you or anyone else for suspending or ending your access.
- Sections 3, 4, 5 (ownership), 7 (licence for retained copies and feedback), 10 to 18 and any other terms that by their nature should survive will survive termination.
10. Availability, changes and your data
- We provide the Service as it is and as available. We may change, pause or stop any part of it, including Friends, Terry+ features and the invite page, at any time and without liability to you.
- We do not promise the Service will always be available, fast, secure, free of errors or compatible with your device.
- We do not promise to store your data forever. Keep your own copy of anything important. You can export your data in Settings > Privacy > Data & privacy.
- Some features depend on Apple Health, Apple, Google and other services we do not control. We are not responsible for them, and your use of them follows their own terms.
- You are responsible for your internet and mobile data costs.
11. No warranties
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", with all faults and without any warranty of any kind. We disclaim all warranties, conditions and terms, whether express, implied or statutory, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement.
We do not warrant that the Service will meet your needs, that step counts or other data will be accurate, or that defects will be fixed.
12. Limitation of liability
To the maximum extent permitted by applicable law:
- Dynomite and its owners, staff and partners are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or use, however caused and even if we were told they were possible.
- We are not liable for personal injury or property damage that results from your walking, exercise or use of the Service.
- We are not liable for content or conduct of other users or third parties.
- Our total liability for all claims about the Service or these Terms is limited to the greater of (a) the amount you paid for Terry+ in the 12 months before the event that led to the claim, or (b) USD 50.
These limits apply to every legal theory, including contract, tort (including negligence), strict liability and statute. They do not limit liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence or for fraud, where the law says so.
These limits apply even if a limited remedy fails of its essential purpose. They are an essential basis of the agreement between you and us, and we could not offer Terry without them.
13. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Dynomite and its owners, staff and partners from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your content, your use or misuse of the Service, your breach of these Terms, or your violation of any law or anyone else's rights. We may take over the defence of any claim you must indemnify us for, at your expense. You will cooperate with us and will not settle any such claim without our written consent.
14. Your rights where you live
Some countries give consumers rights that a contract cannot take away, such as legal guarantees for digital content and privacy rights. Nothing in these Terms limits those rights. If you are a consumer in the European Economic Area or the United Kingdom, you also benefit from the mandatory rules of the law of the country you live in, and you can use its courts where that law allows.
15. Governing law and disputes
- These Terms and any dispute about them or the Service are governed by the laws of the Kingdom of Cambodia, without regard to conflict of law rules.
- The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
- Before starting any legal claim, email us at dynomite.app@gmail.com and give us 30 days to try to resolve it informally.
- The courts of Phnom Penh, Cambodia, have exclusive jurisdiction, except where the law of your country gives you the right to bring a claim in your local courts.
- To the extent the law allows, you may bring claims only on your own behalf, not as part of a class or representative action.
- To the extent the law allows, any claim must be brought within one year after it arises, or it is permanently barred.
16. Apple terms
These terms apply because you got Terry from Apple's App Store.
- Agreement: These Terms are between you and Dynomite only, not with Apple Inc. ("Apple"). Dynomite, not Apple, is solely responsible for Terry and its content.
- Licence scope: Your licence to use Terry is limited to a non-transferable licence to use it on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Apple's terms come first: These Terms cannot set usage rules that conflict with the Apple Media Services Terms and Conditions. If they do, Apple's terms apply to that conflict.
- Maintenance and support: Dynomite is solely responsible for any maintenance and support of Terry, as set out in these Terms or as required by law. Apple has no obligation at all to provide maintenance or support for Terry.
- Warranty: Dynomite is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Terry fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of Terry to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for Terry. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are Dynomite's sole responsibility, to the extent not disclaimed under these Terms.
- Product claims: Dynomite, not Apple, is responsible for addressing any claims by you or a third party relating to Terry or your possession and use of it, including (a) product liability claims, (b) any claim that Terry fails to conform to any applicable legal or regulatory requirement, and (c) claims under consumer protection, privacy or similar laws, including in connection with Terry's use of the HealthKit framework. These Terms may limit Dynomite's liability to you as far as applicable law allows.
- Intellectual property: If a third party claims that Terry or your possession and use of it infringes their intellectual property rights, Dynomite, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance: You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.
- Third-party terms: You must follow any third-party terms that apply when you use Terry, such as your mobile data provider's terms.
- Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
- Questions and claims: Send any questions, complaints or claims about Terry to Dynomite, Melbourne VIC 3000, Australia, or by email to dynomite.app@gmail.com.
If these Apple terms conflict with the rest of these Terms, these Apple terms apply for that conflict.
17. General
- Changes to these Terms: We may update these Terms from time to time. We will post the new version with a new "Last updated" date, and tell you in the app or by other reasonable means if a change is significant. If you keep using Terry after a change takes effect, you accept the new Terms. If you do not agree, stop using Terry and delete your account.
- Entire agreement: These Terms and the Privacy Policy are the whole agreement between you and us about the Service. They replace any earlier agreement or statement.
- Severability: If any part of these Terms is found invalid or unenforceable, that part is limited or removed only as far as needed, and the rest stays in full effect.
- Relationship: Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us.
- No waiver: If we do not enforce a right or term, that is not a waiver of it.
- Assignment: You may not transfer these Terms or your rights under them. We may transfer them, for example if Dynomite is sold or reorganized.
- Events beyond our control: We are not responsible for any delay or failure caused by events beyond our reasonable control, including outages of Apple, Google or other providers, network failures, natural disasters, war, unrest or government action.
- Language: These Terms are written in English. If we provide a translation and it differs, the English version applies, to the extent the law allows.
- Notices: We may send you notices in the app or to the email address on your account. You can send notices to dynomite.app@gmail.com.
